Throughout these Terms of Service, the terms "Rest Society", "we", "us" and "our" refer to Rest Society and its operator.
These Terms of Service govern your access to and use of our website and your purchase of products from Rest Society.
By accessing our website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service and any other policies referenced in them.
Please read these Terms carefully before using our website or purchasing from us.
1. ELIGIBILITY
You may use our website and purchase products from Rest Society if you are legally capable of entering into a binding agreement.
If you are under 18 years of age, you may use our website and place an order only with the involvement and permission of a parent or legal guardian.
By placing an order, you confirm that the information you provide is accurate and that you are authorised to use the payment method supplied.
2. OUR PRODUCTS
Rest Society sells pillows, bedding, sleep products, travel comfort products and other related home and lifestyle products.
We may add, remove, modify or discontinue products at any time.
Product availability is not guaranteed. Products may become unavailable after being displayed on our website or after an order is placed.
If we are unable to supply an ordered product, we will contact you and provide an appropriate refund for any amount paid for the unavailable product.
3. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, specifications, dimensions, materials, photographs and other information displayed on our website are accurate.
However, minor variations may occur between products due to manufacturing processes, materials, lighting, photography and other reasonable factors.
Colours may also appear differently depending on your device, screen settings and display.
These reasonable variations do not affect any rights you may have where a product is materially different from its description, faulty or otherwise fails to meet applicable consumer guarantees.
4. PRICING AND CURRENCY
Prices are displayed in the currency made available to you through our website and checkout.
Where available, customers may see prices in their local currency.
The final price and currency displayed at checkout will apply to your order.
Prices may change from time to time without notice. Any price changes will apply to future purchases and will not change the agreed price of an order that we have already accepted, except where permitted by law.
Promotional prices, discounts and offers may be introduced, changed or withdrawn at any time.
We make reasonable efforts to ensure pricing is accurate.
If an obvious pricing or listing error occurs, we may contact you before fulfilling the order to explain the error. Where appropriate and permitted by law, we may cancel the affected order and refund any amount already paid.
5. ORDERS
When you submit an order through our website, you are making an offer to purchase the products in that order.
An order confirmation acknowledges that we have received your order but does not necessarily mean that your order has been accepted or fulfilled.
We reserve the right, acting reasonably, to refuse, limit or cancel an order where necessary, including where:
• A product is unavailable
• There is an obvious pricing or listing error
• We reasonably suspect fraud or unauthorised payment activity
• Incorrect customer or delivery information has been supplied
• A promotional offer has been misused
• An unusually large quantity appears to be intended for unauthorised commercial resale
• We are unable to fulfil the order
• The order breaches these Terms or applicable law
If we cancel an order after payment has been received and no goods are supplied, we will refund the relevant amount to the original payment method.
6. ORDER QUANTITY AND RESALE
We may reasonably limit the quantity of products purchased by a single customer, household, account, payment method or delivery address.
We may also refuse or cancel orders that we reasonably believe are being placed primarily for unauthorised commercial resale, fraudulent activity or misuse of our services.
These restrictions will be applied consistently and subject to applicable law.
7. PAYMENT
We accept the payment methods displayed at checkout.
Available payment methods may vary depending on your country, currency, device or payment provider and may change from time to time.
By submitting payment information, you confirm that:
• The information supplied is accurate
• You are authorised to use the payment method
• You authorise us and our payment providers to process the transaction
Payment processing may be performed by third-party payment providers.
Your bank, card provider or payment provider may apply currency conversion fees, international transaction fees or other charges that are outside Rest Society's control.
8. SHIPPING
Rest Society currently ships to:
• Australia
• United States
• United Kingdom
• Canada
• New Zealand
Unless otherwise stated at checkout, we currently offer free standard shipping.
Our usual estimated processing time is:
1–2 business days
After processing, our usual estimated shipping time is:
6–15 business days
This means orders will generally arrive within approximately 7–17 business days from the date the order begins processing.
Delivery times are estimates rather than guaranteed delivery dates.
Delays may occur because of postal services, couriers, customs, public holidays, severe weather, high order volumes, international transport disruptions or circumstances outside our reasonable control.
Nothing in this section limits any rights you may have where applicable consumer law requires delivery within a particular or reasonable timeframe.
9. DELIVERY INFORMATION
Customers are responsible for providing complete and accurate delivery information when placing an order.
Please contact us as soon as possible if you notice an error in your delivery information.
Once an order has been processed or shipped, we may not be able to change the delivery address.
Rest Society is not responsible for delays caused solely by incorrect or incomplete information supplied by the customer, except to the extent that responsibility cannot legally be excluded.
10. CUSTOMS, DUTIES AND TAXES
International orders may be subject to customs duties, import taxes, tariffs or other government charges depending on the destination country.
Where these charges are not collected by us at checkout, the customer is responsible for paying any applicable charges imposed by their local authorities.
Where Rest Society is required by law to collect a tax, duty or similar charge, it may be included in the amount displayed or collected at checkout.
Customs rules and charges vary between countries, and customers should check their local requirements where necessary.
11. ORDER CANCELLATIONS
Customers may request to cancel an order within 12 hours of placing it, provided the order has not already been processed, fulfilled or shipped.
Cancellation requests should be sent as soon as possible to:
help@restsociety.shop
Please include your order number.
We cannot guarantee cancellation once fulfilment or shipping has commenced.
If an order has already shipped, the applicable Returns & Refund Policy will apply.
12. RETURNS AND REFUNDS
Eligible returns and refunds are governed by our Returns & Refund Policy.
We currently provide a 14-day voluntary change-of-mind return period for eligible products, subject to the conditions contained in that policy.
Among other requirements, change-of-mind items must generally be unused, unwashed, undamaged and in their original packaging.
Certain hygiene-sealed products are not eligible for change-of-mind returns once the hygiene seal has been opened, removed or broken.
The customer is responsible for return shipping costs for approved change-of-mind returns.
Original paid shipping charges are generally non-refundable for change-of-mind returns except where required by applicable law.
Different rules apply to faulty, defective, damaged or incorrectly supplied products.
Please refer to our Returns & Refund Policy for complete information.
13. EXCHANGES
Rest Society does not currently offer direct change-of-mind exchanges.
Where eligible, customers may return a product in accordance with our Returns & Refund Policy and place a new order separately.
This does not affect any right to a repair, replacement, refund or other remedy that may apply to faulty products under applicable consumer law.
14. WARRANTY
Rest Society provides a 12-month warranty against manufacturing defects, beginning from the date the product is delivered.
This warranty is subject to the conditions and exclusions described in our Returns & Refund Policy.
The Rest Society warranty is additional to any consumer guarantees or other rights that cannot legally be excluded.
Australian customers may have rights under the Australian Consumer Law that continue beyond our stated 12-month warranty period.
15. SALE AND FINAL-SALE PRODUCTS
Products identified as Final Sale are not eligible for our voluntary change-of-mind return policy.
Other sale or discounted products may also be excluded from voluntary change-of-mind returns where this is clearly disclosed before purchase.
A sale, discount or Final Sale designation does not remove any mandatory rights that apply to faulty, damaged, incorrectly supplied or otherwise non-compliant products.
16. PROMOTIONAL CODES
Unless otherwise stated:
• Only one promotional or discount code may be used per order
• Discount codes cannot be exchanged for cash
• Discount codes cannot be applied retrospectively to completed purchases
• Promotional offers may have eligibility requirements, minimum purchase amounts or expiry dates
• Promotional codes may not be used fraudulently or contrary to the conditions of the promotion
We reserve the right to withdraw or correct a promotion where there is an obvious error, fraud, misuse or technical issue, subject to applicable law.
17. CUSTOMER ACCOUNTS
Customers may be able to create an account through our website.
You are responsible for providing accurate account information and for taking reasonable steps to keep your login details secure.
You should notify us promptly if you believe your account has been accessed without your permission.
You must not use another person's account without their permission.
We may suspend or restrict an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.
18. ACCURACY OF INFORMATION
We make reasonable efforts to keep information on our website accurate and current.
From time to time, information may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping information or other content.
We may correct errors and update information where appropriate.
Nothing in this section allows us to avoid an accepted contractual obligation or a mandatory consumer right.
19. WEBSITE AVAILABILITY
We aim to keep our website available and functioning properly.
However, we do not guarantee uninterrupted or error-free access.
The website may occasionally be unavailable because of maintenance, updates, technical problems, internet outages, third-party services or circumstances outside our reasonable control.
We may modify, update or discontinue website features from time to time.
20. ACCEPTABLE USE
You must not use our website or services:
• For unlawful or fraudulent purposes
• To infringe the rights of another person
• To submit false or misleading information
• To distribute malware, viruses or malicious code
• To interfere with the security or operation of our website
• To attempt unauthorised access to our systems or accounts
• To scrape, harvest or extract information in a way that interferes with our services
• To impersonate another person or business
• To misuse promotions, payment systems or customer accounts
• To engage in conduct prohibited by applicable law
We may restrict access to our services where we reasonably believe these Terms have been seriously or repeatedly breached.
21. INTELLECTUAL PROPERTY
Unless otherwise stated, the content made available through the Rest Society website, including our branding, logos, text, graphics, photographs, product presentation, website design and other original content, is owned by or licensed to Rest Society and is protected by applicable intellectual property laws.
You may use our website for normal personal shopping purposes.
You may not reproduce, distribute, commercially exploit, modify or republish our protected content without permission, except where permitted by law.
22. REVIEWS AND CUSTOMER CONTENT
If you voluntarily submit a review, photograph, comment, testimonial or other content to Rest Society, you confirm that you have the right to provide that content.
You must not submit content that is unlawful, defamatory, misleading, abusive, discriminatory, infringing or that violates another person's privacy or intellectual property rights.
Where you submit content for publication, you grant Rest Society a non-exclusive, royalty-free licence to display and reproduce that content for reasonable purposes connected with operating and promoting Rest Society, subject to applicable law.
We may remove customer content that reasonably appears to breach these Terms or applicable law.
23. THIRD-PARTY SERVICES
Our website may use or integrate services operated by third parties, including ecommerce, payment, shipping, analytics and technology providers.
Those third parties may have their own terms and privacy policies.
We are not responsible for a third party's independent services or conduct except where the law makes us responsible.
24. THIRD-PARTY LINKS
Our website may contain links to websites or services operated by third parties.
These links may be provided for convenience or informational purposes.
Unless expressly stated otherwise, Rest Society does not control or endorse third-party websites and is not responsible for their independent content, security, availability or privacy practices.
25. PRIVACY
Personal information collected through Rest Society is handled in accordance with our Privacy Policy and applicable privacy laws.
By using our website, you acknowledge that certain information may need to be processed by third-party providers in order to provide services such as payment processing, order fulfilment and delivery.
Please review our Privacy Policy for further information.
26. CONSUMER RIGHTS
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, statutory right, remedy or other protection that cannot legally be excluded, restricted or modified.
For Australian customers, our goods come with guarantees under the Australian Consumer Law.
Depending on the circumstances, these rights may include rights to a repair, replacement, refund, cancellation or compensation where a product or service fails to comply with applicable consumer guarantees.
These statutory rights exist independently of any voluntary warranty or change-of-mind policy offered by Rest Society.
27. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
To the maximum extent permitted by applicable law, Rest Society is not responsible for loss caused solely by circumstances outside our reasonable control or by a customer's unlawful or improper use of our website or products.
Any limitation in these Terms is subject to all applicable consumer guarantees and other mandatory rights.
We do not exclude liability for loss or damage where such liability cannot legally be excluded.
28. EVENTS OUTSIDE OUR REASONABLE CONTROL
Rest Society will not be responsible for a delay or failure to perform an obligation where that delay or failure is caused by circumstances outside our reasonable control.
These circumstances may include severe weather, natural disasters, transport disruptions, customs delays, industrial action, government restrictions, widespread telecommunications failures, courier disruptions or other similar events.
This section does not remove any mandatory rights you may have under applicable law.
29. TERMINATION
You may stop using our website at any time.
We may suspend or terminate access to our website where a user seriously or repeatedly breaches these Terms, uses our services unlawfully or fraudulently, or creates a genuine security risk.
Termination does not affect rights or obligations that arose before termination.
30. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.
The remaining provisions will continue in effect.
31. WAIVER
If Rest Society does not immediately enforce a provision of these Terms, this does not mean that we permanently waive the right to enforce that provision later.
Any waiver must be consistent with applicable law.
32. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Returns & Refund Policy, Shipping Policy and any other policies expressly incorporated into them, form the terms governing your use of our website and purchases from Rest Society.
Nothing in this section limits any rights that cannot legally be excluded.
33. GOVERNING LAW
These Terms are governed by the laws of Western Australia and applicable laws of the Commonwealth of Australia.
However, if you are a consumer located outside Western Australia or outside Australia, this provision does not remove any mandatory consumer rights or protections that apply to you under the laws of your place of residence or purchase where those rights cannot legally be excluded.
34. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, website, products, services or legal obligations.
The current version will be published on our website with an updated "Last updated" date.
Changes generally apply from the date they are published.
Orders already accepted will generally remain subject to the terms that applied when the relevant order was placed, unless a change is required by law.
